1. Use of the Service
HeartChart is an app that allows users to create visual cardiac surgery case diagrams, add related procedural details, and generate PDF case summaries. You may use the Service only in compliance with applicable laws, regulations, and professional obligations.
2. No Medical Advice
HeartChart is a documentation and visualization tool only. It does not provide medical advice, diagnosis, or treatment recommendations. The Service is not a substitute for independent clinical judgment, professional training, or institutional policy.
3. User Content and Responsibility
You are solely responsible for any content you create, store, export, or share using HeartChart, including diagrams, case details, procedural information, and PDFs. You agree not to use the Service in a way that violates patient privacy, confidentiality, contractual obligations, or applicable law.
You are responsible for ensuring that any use of patient-related or case-related information complies with HIPAA and any other applicable privacy, confidentiality, institutional, or professional requirements.
4. Accounts and Subscriptions
Certain features may require sign-in or an active subscription. Subscription billing, renewals, and cancellations are handled through Apple’s App Store in accordance with Apple’s terms and policies.
If you purchase an auto-renewable subscription, your subscription will automatically renew unless it is canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Apple account settings.
5. Acceptable Use
You agree not to:
- Use the Service for unlawful, fraudulent, or misleading purposes.
- Upload or share content you do not have the right to use or disclose.
- Attempt to interfere with, disrupt, or gain unauthorized access to the Service.
- Reverse engineer, copy, modify, or exploit the Service except as permitted by law.
6. Intellectual Property
HeartChart, including its design, branding, software, graphics, and related content, is owned by or licensed to its operator and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.
7. Availability and Changes
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
8. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of Liability
To the fullest extent permitted by law, HeartChart and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or business opportunities arising out of or related to your use of the Service.
To the fullest extent permitted by law, the total liability of HeartChart and its operator for any claim arising out of or relating to the Service will not exceed the amount you paid, if any, for use of the Service in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless HeartChart and its operator from and against claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
11. Termination
We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or used the Service in a manner that could create legal risk or harm.
12. Governing Law
These Terms are governed by the laws of the jurisdiction in which the operator of HeartChart is based, without regard to conflict of law principles.
